So after a long conversation with Tim over at Exotic Aquariums about they're Gen 2 Sunbrite LED Systems, I found out why they are not affected by the Orbitel Patent.

The reason why PFO was targeted is because of the type of LED system PFO decided to produce. PFO uses an RGB LED that is tied to a circuit board and controller that controls the intensity of light therefore creating the light spectrum through Red Green and Blue. It is that type of RGB controller that Orbitel owns the patent on. So many of us who were misunderstanding the lawsuit came to false conclusions. Orbitel does not have a wide-encompassing LED for all Aquatic application lawsuit. They're patent is on the type of control that the Solaris copied.

Sunbright gets around the patent by using single spectrum bulbs just like all other aquarium light fixtures. 440nm, 460nm, 12K, 16K, 22K, 65K(for freshwater). They do not offer a dimmable controller because that will infringe upon the Orbitel patent. They use a good old fashioned digitally timed built in on switch for each bulb. It simulates sunrise by turning each bulb on from lowest to highest in intensity. Conversely, it simulates sunset by switch the highest off first down to the lowest. Not quite as glorified as the controller that the Solaris had but still effective.

I hope this sheds some light on the Orbitel PFO lawsuit. There are still many high-powered LED systems out there. Unfortunately, PFO did not do they're homework when they started using that type of controller.

Inside info: Sunbrite will start an off-shore website that shows the DIY DMX style control that can easily be added to their system. Warranty beware!
