They didn't file till 2004.. did anyone have an LED light on an aquarium before then? Seems pretty hokey since people have had various types of light sources with controllers on fish tanks for so long.. this is what is wrong with the patent/legal system.. it's not the validity, but who has the deepest pockets.

I am pretty sure Dana Riddle and others were playing around with these way before then. I almost made one for a cube tank I had in 2001 complete with x10 dimmers and controller.

Thanks guys for the information on this lawsuit.
For the life me, I still don't understand Gresham's hesitancy in being forthright when he raised it as this is a matter of public record.
Being from Canada I simply did not know where to look. :roll:

Back in 2003 I had screwed around with having an LED light above my aquarium... :D

Those that will be/could be affected know.... those that don't, don't need to know. It's that simple really. Those that are involved informed those that could be affected. If you didn't get that call it's really non of your business :) Wayne has no need to know other then his own sense of self worth in regards to the MO industry which is why I didn't post anything. Plus, the internet is hardly limited to the US, nor is using Google. With some creativity he could have landed all that and more, but good thing he's got friends like you all :)

Gee Wayne, aren't you an attorney? I thought you were... and therefore you should have an inkling about where to look for such things...

And yes, I believe Dana was doing research with LEDs several years ago. I met him in late 2003 when he was in town to give our local reef club a reprise of the talk he'd given at MACNA that year, and he talked about the results of corals being exposed to different colours of LEDs - I think they were green, blue and red. I definitely remember they did not respond well to red (Pocillipora sp. I think) but they did respond well to blue. I'm not sure how that pertains to the legal battle etc., but yes, prior to MACNA 2003 he was working with that, in order to have the data to present at that conference. I think he was here in town shortly after that MACNA. He usually comes to the Atlanta area whenever he's on the mainland if he can, because he hails from a town just up the road a bit from me. In fact, whenever he's back this way, he comes to see me and we "do lunch". He's been here twice in the last few months.

I'm no lawyer, and I didn't stay at a holiday inn last night, but IIRC the death blow for any patent is if someone was selling a product that your patent basically is before you applied for the patent. Not quite sure that simply doing research on that particular object counts (one reason why universities fight very hard to patent "usable" stuff their slav.. er grad students work on)..

That being said I'm sure PFO has actual attorneys and don't need advice from people on a fishboard who might have known patent attorneys in the past :D

There are DIY LED threads on www.nano-reef.com from before then.

I thought it predated that, but I lose track of the years.

I remember hearing back in the mid 90's I think that "sulphur" lighting was going to be the next thing, never happened. Maybe that plasma light will be cool and we won't even want LED's anymore.

That is not true Gresham. You posted this in response to an earlier poster:

You could not have known that I was going to post.

BTW, I know how to get court cases in Canada but with the limited info I am not sure Google would have helped which is why I asked Greshma for more information.

I found it with limited info - PFO Lighting Lawsuit. I didn't have any other particulars either. I just did not post my findings.

Google is a wonderful thing.

from what I can tell, none of that matters - all that matters is who applies for and recieves the patent - its happened several times in the video game industry - a company called Immesion managed to get the application for a "Forced Feedback" mechanism a couple years ago - and they sued Sony, M$, Nintendo, Sega, and anyone else that has produced a game controller with a "rumble Pack" - Sony lost, and had to pay the company 90 million.
Orbitech managed to procure the patent, and as a result can demand royalties for PFO's LED lighting systems.

Um it is true, stop being a tool :lol: . YOu do not know what I was thinking either ;) The post you quoted is the truth! I stand behind what I wrote. Google works but apparently you can only half quote and don't know how to use Google. When you learn how to use PHP code let me know, it's only been 8 years since you joined this site :lol:
