Speeding ticket!!

My wife just called me and told me she got a speeding ticket on the Bruckner I believe doing 72 in a 50mph zone.This is her first speeding ticket and they took off 6 points!!!She's worried if she gets another,they'll take away her license.Should she plead not guilty and pay her ticket or plead guilty and pay it anyway.Either way I'm sure she'll pay it but would they reduce her points instead of 6 points?She needs to get to work and this is the only way for her to get around.

Hire a traffic attorney. They may cost you some money but they are effective. In a lot of my cases they got the summons thrown out or at least reduced to no points.

I'm sure you'll be getting the soliciting letters in the mail. I no longer have a relationship with anyone in New York so I can not recommend someone but I'm sure there are members on the board who can.

Tell her to go to court and plea it down and pay full fine. NYS just wants the money, thet dont care what violation its for. They will call it a seatbet ticket or something.
IME this is what usualy happens in, Nassau county anyway

I read that they won't take it way unless you have more than 11 points in 18 months.She's stressed about it,she was one of the unlucky ones who happen to get caught while everyone else is zooming by over the speed limit.Thanks guy.

Zany winning against a highway cop is very tough their testimony is seldom less than perfect. A lawyer gives you the best chance to win however not a perfect shot. There is no pleading down in NYC to just pay a fine that is not allowed. Good luck.

You think $350 is alot, wait until your auto insurance company finds out about the ticket especially if you end up with the full points. You can probably find someone to handle your case cheaper than $350. Another advantage of a lawyer is in most cases you don't have to show up at court. They go as your representative.

Good advice Cheif.
Im only farmilliar with nassau county. In nassau you can sit in court for 3 hrs. and watch them plead speeding tickets for a seatbelt (in points) 10 times.
I plead a red light violation down to an impropoper use of horn, as long as i paid full fine.

Chef I know all too well about traffic court as I spend lots of time there. Unfortunately NYC isn't NC the NYPD pretty much forbids the plea deal bargain practice with their cops because in their eyes it is a corruption issue.

I wish I could recall where I read it, but it was many years ago...but what I read has never left me... IIRC the likelyhood of surviving a crash at a speed of 73 mph and above drops enormously!
Maybe you ought to tape a picture of your kids on the dash next to the speedometer...and set the alarm 10 minutes earlier.
Sorry to get on a soapbox but I grew up nearby to an auto body shop and saw way too many windshields with bits of peoples faces still stuck in them...Please stay on your wife about the speeding

I just plead guilty to 74 in a 55. On my bike in the HOV lane of the LIE. I told the cop "I am late for work". He wrote on the ticket 'states he was late for work'. I felt like that was admitting guilt so I didn't get a lawyer. I wish I did now. Hind sight is 20/20 :irked:

is this her first moving violation.if so how long has she had her license for.i got pulled over last year doing 60 in a 40 and i never had a moving violation before in 14 years.and the judge through it out.and it was in brooklyn not LI.

It's been over 25 years since a moving violation and it was in NJ.She's been driving for over that much I would imagine.She's got 7 years on me.

The NYPD has nothing to do with the plea deal nor does it have anything to do with corruption. Its all how the city decided to to handle traffic violations. They chose to use the NYS Traffic Violations Bureau, which has nothing to do with the NYPD or the city and they are the ones who will not plea bargin tickets. Its like that in any city/county in NYS that uses them. NYS TVB = no plea bargin. Others, like Nassau, and even sections of Suffolk and upstate, let the individual village courts reign over the summonses and thus allow plea bargining. The city just chose to use the NYS TVB because their courts are busy enough as it is without having to use them for traffic tickets.

But Chief is right, winning against a highway cop is next to impossible, even for a lawyer. I've faced many a lawyer in traffic court, as has Chief, and I very seldom, if ever, lose to a lawyer. And if I do its because of something stupid I did, not because the lawyer had some bag of tricks up his sleeve. I personally think hiring a lawyer is a waste of money for the inevitable.

I write speeding tickets, and I must concur with the other cops who have commented: you RARELY beat them. I get beat about 40% of the time on other violations because they are harder to testify to and the situation is always different (positioning of police car, direction of travel, uncommon violations, etc.), but when I testify for a speeder, its a set list of points I have to mention and unless you have some amazing excuse (which means I would have used discretion on the scene anyway), or I make a mistake, then you lose.

Recently, I lost because instead of making notes like I usually do, I went off of my copy of the summons and said the wrong date. Other than that, I haven't been beaten in the 4 years I have been radar qualified. And this is in Brooklyn where the judges are fairly liberal and cops normally have horrendous conviction rates (I am not a highway cop...)

I got beat on a sign violation last week because after I testified that the sign said "No Turns 7am - 7pm Except Buses" and that I observed a black 2005 Acura bearing NY passenger reg ABC1234 disobey the sign and make the turn, the judge said to me "Well, you didnt say that the black Acura was not a bus." The said part is, I've written this summons at this location and gone in front of this judge I cant count how many times, and he threw it for that. F'in bastard. Ah well. :lol2:

But I do have to say, Queens North is pretty easy to convict... usually.... except for that damn summons.
