Here is what I would do and have done this in the past. Contact your insurance company with all of the information. File a case.Then, when car is repaired insurance company will give you all money minus deductible.

However, then the insurance company should try to fight for your deductible. So in a few months you should get that back. At least that what my insurance company has done a couple of times in the past.

What they explained to me was that my deductible does not exceed the damage that was caused. Since it will be paid out of my pocket and they didnt pay anything out, they cant fight for me. The case will be closed by my insurance company since I technically one however, they told me that he had a lapse in his insurance so i cant even go after his insurance company.

Wow, then what the hell is Uninsured Motorist Insurance good for. You should have filed a report and sued for severe neck trauma, a fractured rib and carpel tunnel syndrome. That would teach that SOB to drive without proper papers.

update!

I just found out the other driver had expired insurance. Now what the hell can i do?

wait for him with a brick in your hand it might be a route he passes at the time of day you had the accident if you see him aim for the windshield

You can report to the police that he was driving without insurance. He will get his license revoked for at least a year, possibly plus fines
And for the money, go to small claims court.
