Well honestly I didn't really read your post until now, but it makes sense in court you need to submit proof somehow. It's just common sense, I'll admit I'm no lawyer but the idea that you're apt could be illegal is kinda scary. I've never really rented so I don't know much about how that works but definitely worth looking into.

So, homes.com says single residence... but also sale value as $85,000.. it's a huge house.

Also the map pin points it a bit off probly by a few hundred yards.

Zillow says single family too, and $285,000, that sounds more realistic.
Well as long as you google the address you can find out everything about the house. If it says single family then it's illegal like I said. So you basically have him by the balls. If he screws you you can call the buildings department and report it as illegal housing and they will come and inspect then he will get fined like crazy for all the illegal conversions and also have to rip the house apart making it back to the original way it was as a 1 family based on the blueprints. Only do that if he screws you and you plan on moving because it can get very ugly especially if you don't give him rent. However just letting him know you know it's illegal if he doesn't want to fix a problem will definitely make him jump when you ask for something.

I been working with building managements since 96, we deal with HPD,DHS,DHCS,HUD,BANKS, everybody that has money involved in the building. By law management IS responsible to remove any rodent,bugs,critters....but it is there responsibility to let you know that what they using is harmful to pets or you...that being said IT IS UP TO YOU TO REMOVE YOUR "PETS" what ever that may be.

And just cause you take it upon yourself to do it does not mean that you will win in court for damages

Mind you this is my personal experience.....

So, I may end up having to bug bomb my apt due to bird mites that came from a birds nest in our wall. They got in through a hole in the roof outside. If I do so, I plan on wrapping the tank in saran wrap and I even bought a grill cover to put over it.

What I want to know is if I do this and have loses in the tank, can I make my manager responsible for the cost of replacement?

We told him when we noticed the issue on Sunday and that he needs to remove the nest (the source) in order for us to stand a chance in getting rid of them. He still has not done it an said maybe tomorrow. We are now finding them everywhere, not just localized like Sunday.

Now that I've read this a bit better :)

Unless they are biting or physically effecting the tenant like bed bugs,rodents,insects, then the landlord or management has a certain amount of time to remove them...... And birds I can assure you are not an emergency.....
mind you I'm trying to give you a sense of how the courts and the landlords lawyer are going to see it

And if you do it on your own and some thing happens to your tank it might be extremely hard to get anything back.......

Most leases I have seen do not allow pets but....the ones that do, make provisions for the landlord to periodically "spray" for bugs. The leases also state that the landlord must give the tenant ample notice in order to remove their pets along with limiting the liability (the good leases) of the landlord in reference to the "spraying".
On another note, are you or any of the people that live in the apartment any relation to the landlord ?
Is the attic (where you live) somehow connected to the floor below you ?

No one is related as far as I know. There are 3 apts on the 3rd floor that have shared space. 3 on the 2nd floor, 2 of witch share the 3rd is a full apt. And me and my wife live on the 3rd floor by ourselves. It was an attic converted to a loft.

Yea legally ur suppose to have a copy of the lease. Landlords are responsible to get rid of bugs if any damages are do to the bug invention they have to reimburse u. But u have to get a copy of the lease to prove it. Most small houses get a generic lease they buy from staples and it states they pay for the losses due to bug infestation or damages. I know this because my girl friend is a property manager. You should always be familiar with ur lease just in case. But is is hard to prove fish dying from the chemicals.

I feel so bad for this poor mexican dude he hired to do the work outside.

No gloves, covered in mite, he just hosed himself off. They found birds in another place, but not where I am talking about. They must have burrowed in way further then the hole.

He needs to rip it aparts and look inside...

So, we had my landlord had an extermintor come too on Friday.

He did not bomb the has but did spray and use a fogger that we had to leave the place for several hours. I got up at 6 to wrap my tank as good as I could before I went to work.

Everything seems to be doing fine. Only issue was that the duct tape I used ripped off part of the latex paint I just did on the back a few months ago. Easy fix, that will take me weeks to get to...
