This guy is a hoot.

All "in forma pauperis" means, is that you can't afford to pay the filing fees associated with submitting a case to the courts. Without it, the poor would have no recourse to the law.

Because to do otherwise would deny them there constitutional right to the courts. It is a very, very small price to pay to make sure there is equality before the law.

It would probably cost more to make sure that the case was not frivolous before granting "in forma pauperis", and to do so would open the door to abuse. You would have to have a clerk available to review every single case that is brought, the vast majority of which are not frivolous. You would then need to have a review panel established to determine if the clerks decision that the case was frivolous was proper as most clerks have very little in the way of legal training and are unlicensed. Of course you could have a judge do this but that would just up the cost.

There is also the potential abuse. How do you decide if a case is frivolous. Desegregation cases brought in 1950s Alabama would probably have been labeled "frivolous" by the state courts, let alone by an underpaid clerk sitting in the basement of the Mobile court house. Perhaps, Michael Vick did steal his pit bulls.

Also, don't assume that what he is doing will go without punishment of some sort, I would need to do research into the issue but his actions could be considered to be "interfering with court administration", "Contempt of Court", Harrassment or violation of a host of other rules, laws, and ordinances.
