I have some questions, so I'll ask them after I explain my situation:


Last year in October, I had parked my vehicle on the street to wait for my parents to get off work. While I was waiting, I was hit from behind by a TLC vehicle. Pretty hard considering my vehicle was a old Toyota Landcruiser and it shifted forward. I called the police immediately and filed a report with them. Then I received my accident report number and picked up the report after the weekend. I called my insurance company, reported the accident, and through them found out who the other person's insurance carrier is. I called them to report the accident as well. They sent me a accident report sheet and asked to explain everything, which I did, then I also copied and sent them a copy of the police report. They never sent anything back and rarely picked up the phone after that. It took 3 weeks just to get them to send a adjuster out to look at my vehicle. While I was speaking to the adjuster, I asked if I needed to get a estimate from a car repair shop, and he said that I don't need to. About 10 days pass by with no word and no mail of the adjuster's estimate. Another week of calling and getting nowhere and finally, I got through to the case worker again and they sent my a claim of $1900 to fix my vehicle. I thought they were lowballing me so I went and got a estimate and it was almost $3300! I had to call them again and they said they have to send the adjuster to the repair shop where I got my vehicle's estimate and told me to leave the vehicle there. Well, it took almost 1 month after that just to get the danged adjuster to appear! Finally, they approved my estimate and told me to get the vehicle repaired. They sent me a release letter that stated that it has to be signed and notarized before they release funds to me. I had done that and sent them back the letter. Then, 2 weeks go by without a single trace of a check. Car was already repaired and I had to pay out of pocket or they won't release the vehicle. I called for another 2 weeks before they finally told me the check was on the way. Finally, I received a note from the post office for a 44 cent COD for a letter. I was wondering what it was so I went and paid for it. Lo' and behold, it was the check! I was elated that I was finally paid. But was disappointed that they were too cheap to even pay a 44 cent stamp for sending the mail. I went to deposit the check, and just today, I received the check from the bank and it stated that they stopped payment on the check!! I'm mad as hell at this point, and I'm not even sure what I can do at this point.


1. I was wondering if there are any ways of reporting this to the authorities. Is it considered a crime of any sort for what they're doing?

2. Would it be a better idea to call them again and try to get them to send another check? I'm just tired of this runaround. I think I must've called them close to 100-120 times from the day I received the police report til last week.

3. If I do try to take this to small claims court, do I file in their county, which is in LI or do I file in my county?

4. Comments and advice on any other ways are very welcome at this point. I'm so tired and distraught from having to deal with those a$$ho1es.

< can give you all the info you need, i work at a bodyshop as an appraiser, the insurance company broke several state laws and several things in article 64

I've tried calling them. They just told me to call the other company and ask why that happened. Not exactly helpful.. but I guess that's the best choice for the moment. I have thought about retaining a lawyer. I wanted to see if there are any other choices besides what I've tried and known before turning down that road.

i would keep calling them and ask to speak to a supervisor, or look up the company and call their corporate office, ive had to do this a few times myself over claims, corporate doesn't want ot hear people aren't doing their jobs. i wouldnt tell them you filed with nysi though, but tell them your at the point of filing a claim with the state. and don't know how long for the state to reply on a claim. lawyer really isnt going to be able to do much, and if i remember correctly they have 30 days to get payment out to you. your insurance isn't going to do crap cause it didn't cost them anything

Assuming this happened in NYS, you don't need a lawyer. You can take them to small claims court for up to $5000 ( last I checked though limits may have changed ) and the jurisdiction is the one in which the incident happened ( though I may be wrong and it may be the state where the corporation is based so double check that one ). Corporations must be represented by a lawyer regardless of whether it is a one person business or a multinational so it usually is cheaper for them to settle than to bother fighting the case. The fact that they sent you a check implies that they accepted your claim. The fact that they stopped it implicates them and it should be an open and shut case. Just double check which jurisdiction it is under.

If you go the small claim court, make sure that you include all the money you paid related to this instant such as parking fee, car rental....etc. You will get all the money back b/c you case is strong. Don't listen to their lawyer if they want to settle for half and stuff. You should be pay in full.

How much per year do you pay for insurance (don't answer this it is purely figurative)? Things like this should be handled by them. They have lawyers on staff to handle this type of stuff as well. They should be fighting for you instead of you fighting the other party's company and you begging yours to help you out.

I would call your agent, arrange an appointment and tell them that if they don't start doing what you pay them to do, once this experience is settled you are going to find another company to give your hard earned money to.

Update:

I've called them today, probably like, 10 times. No answer, with the claims manager and the supervisor. Then I called my insurance company. They said they couldn't do anything more than help me call them since they don't have a claim with their company and it was my father (Car is under his name), who has the claim. After calling them like, 2-3 times, the lady was able to get through to the supervisor. Then the supervisor claims I haven't gotten permission with my father to talk about the claim! I mean, WTF! We've only been talking like, what? 4 months on this case already? Anyway, they claim that a check was mailed out on 1/19. I'm wondering if they really did considering it doesn't take 'that' long to receive a letter. So finally, I had my dad call again (He doesn't speak English very well so it must've been comical to see the reactions), and they said that he'll receive the check today or tomorrow.

your insurance co wont help u with a claim against them if you only have liability coverage. they will only help u if some1 sues u, not the other way around.
chasing after payment is pita, n they will make it even more pita cause they hope u will give up chasing after them. they will look for any loophole to avoid paying and/or pay less. insurance co have that down to an art cause thats part of how they make $.

Yeah.. That's so totally true. I received the check by Fed Ex today. I hope it's the end of it after I deposit the check. That's the last thing I hope to ever have to deal with this crappy company.
