help with speeding ticket (suffolk)

I will say though states - Ill quote Tennessee they make it harder on you wallet wise than if you would just have accrued points.

Deals Gap Tennessee- is a section of Hwy. US129 that crosses from Robbinsville NC to Tennessee- is a huge motorcycle attraction- The tail of the dragon- 318 curves in 11 miles, their speeding tickets are $50 for every mile an hour over the posted 30MPH speed limit.

On top of that every ticket is an appearance ticket. States are well aware of other states including NY not issuing points for out of state tickets and is why I believe touristy spots such as there make it a burden on you to keep people from ignoring their laws. They've gotten sick of out of staters coming down and tearing up their roads and costing their state to respond to accidents and not getting revenue,

All the accidents happen on the Tennessee side- all the hotels and restaurants are on the N.C. side.

So if you get a speeding ticket of 40 in a 30 its costing you 500 for the fine and days off work as well as travel costs and hotel bills. Tennessee-->:fishhit:<--speeders

Give me a few points that I can take care of with a defensive driving course, but a lot of points sucks.

long story short i have 2 speeding tickets that are almost a year and a half old. do my points expire after the 18 months? do i still need to pay the driver responsibility fee?

why haven't you gone to court yet?
and for points expiring... only a few a year expire, not the entire thing. I think in NJ it's like 2 points expire every year after the points are posted on DMV.

How does an insurance company charge you penalties without a court conviction? you could go to court and maybe get a lesser point ticket or even no points with heavy fines. in any case in nj the dmv dont know about the ticket until after court and they process it to dmv and then insurance company.

I've gone to court and gotten points reduced or taken away, which is when they notify the DMV and insurance company.

The last ticket I got I had the police station send me a copy of their speedometer checks, their radar gun checks, etc. and when I took that to court, my 6 point violation got reduced to 2 because they didn't have the right paperwork. The radar gun is supposed to be re-checked every year or something and the person using the radar gun is supposed to be re-trained every 6 months? there's other stuff but I don't remember... I wrote a letter to the office and they sent it all to me.

i have 2 tickets that have been postponed for since dec of 08. 6 points each. im pretty sure points are cleared after 18 months from the date you received the tickets wich means i have no points as of june. i think anyway. i know a lawyer but if i have no points i wont need a lawyer. and that would save me a lot. theres my confusion

Actually, in NJ, 3 points come off your license every year, never falling below zero, of course. Points, together with all other penalties, are from the date of conviction/plea, not the date of the offense.

You got lucky with the bad paperwork. In 15 years of practice, I've only ever had that happen once. Get a lot of tickets, though, do you? Perhaps I should send you my card.

You better fight it 40 in a 30 that 6 points and you have 2 speeding tickets if it a nother 6 points the juge it going to suspend your license and i think It will be for 1 year . You better get a lawer . anything over 5mph over the speed limit is 6 points . I should now I had gotting alot of speeding ticketes the worst was 80 in a 30

get a lawyer, they will not down the fines and settle points. make sure you bring representation with you. And its good to know a few PO's to get some PBA cards (hint, hint!!)

I dont think your points will clear up UNTIL after you accepted the guilty verdict. If they are both in the same county, you should consider getting a lawyer from that county. Almost 99% of the cases, they know the people in the courtroom to work out a better deal for you. Aside from you points and insurance, those 2 tickets are going to cost more than your lawyer fees

Insurance also looks at your records the last 5 years....You can also take a chance and show up to court hoping that the judge will be more kind to you. If you have to eat up 12 points, you are at the license suspension tier.... After the verdict, if you still have some points, you can take a course for points reduction. Regardless, you should try to resolve this and put it behind you.

From the NYS DMV:

The DMV computer system automatically calculates your point total as follows:

• You must be convicted of the traffic violation for the points to be added to your point total, but the calculation of your point total is based on the date of the violation, not the date of the conviction.
• The points for violations that all occurred within the last 18 months of one another are added together to calculate your point total.
• The record of the conviction, and the points, are listed on your driver record for as long as the conviction remains on your record. The information about the conviction and points is not removed after 18 months from the violation date. Only the calculation of your point total changes. Learn more about convictions and your driver record.

and 40 in a 30 is not 6 points as per their table. 21-30mph over the speed limit is 6 points (so 51-60 in a 30 )

well I only got driver surcharge after the points were added to my license...so if your points never make it to the DMV then maybe you won't have to pay. and it's like $100 for every 2 more points you get... =(
I had to pay like $350. =(

the funny thing is, if you think the procecutor will work something out with you on 18mo old tickets, they will laugh at you and ask you y you didnt come to court when it happened.. in nj(this is where so far you are lucky) after 6 mo there would have been a wattent out for your arrest and you liscense suspsended indefinitly.. and the you will have to fine for not showing up, fines for not paying your fines, reinstation fees and dmv surcharges for 3 years. oh and if you find out you have a warrent and you liscense is suspended bc you got pulled over your getting a ride in the back seat.

good luck.. altho i think this is gonna cost you alot and the insurance will probably drop you so start looking for high risk insurance

Last time, I got a speeding ticket 4 years ago, it was reduced to a hefty no point fine of $550 including the local court fee. The prosecuter didn't care that I was way over the speed limit. As long as I didn't get 3 moving violations in the past 3 years I can get a no point fine. Most of the time in NJ, you can knock down a 4 point moving violation to a no point fine w/o a lawyer. It's money going to the local township pocket rather than DMV or insurance.

No matter where you get a ticket, it depends on the prosecuter and the judge.

If you're at risk of getting 12 points, definitely get a lawyer. I'm sure you must have received tons of mailings from lawyers the days after the ticket if you kept them. I made the mistake of paying a moving violation ticket instead of fighting it early on after I got my license that was a costly mistake for many years to come on the insurance.
