It's a civil matter, call a couple of landscapers and get some estimates to repair your lawn, take pictures to prove the damage is done by their dog sue them civilly.
if it happens again and you SEE it going on the lawn then confront them 1 more time with a harsher deminer.

if you follow this advice you will give your neighbor a reason to make this a police matter. I understand your position but it's not a reason to get arrested.
It sucks that your neighbors do not respect you or your property
in a civil matter you need only to prove a "preponderance of the evidence" to have the court decide in your favor(which should be pretty easy to do with pictures). if you win and they fail to comply with the courts' decision you can now have the police enforce the courts decision.

You have already confronted them and it hasn't remedied the situation you might be able to push the limit and claim that they are allowing their dog to defecate on your lawn to harass you. If your lucky maybe them seeing a marked police car parked in front of your house and you pointing out the damage they may get the hint
good luck!

The best course of action is to video tape the dog on your property and then take the tape to the animal control officer with a complaint or you can contact the ASPCA and report your neighbors for animal cruelty for leaving the dog outside unsupervised and without a leash creating a potential danger for the animal or you can go to civil court and sue your neighbor.

Well, the dog is on a leash and the owner walking the dog purposely let the dog get on our lawn to do her thing (sometimes up to 20-30 ft into our lawn) while he/she watch at curb side. If the dog poops, I've seen her come into our property to pick it up.

It will be hard to prove that the grass died because of the dog and not for other reasons.

Now, who can loan me a police car to park in front of my lawn for a few days?:scratchch

Regal, first and foremost I am truly sorry that you have such a RETARDED neighbor. Second is there a community board, or civil county court that may have a "Mediation Dept." in your county? If so can you go to them with this problem? Make sure to take pictures of the neighbor with the dog on your lawn. And do get some estimates from a couple of landscapers on what it will cost to repair the damage done by her dog. It should not be so difficult to prove that the damage is from her dog's urine & feces as you will have pics of them allowing it to go on your lawn.;) Also take a pic of "The Curb Your Dog" sign in your yard.

By the way, I've been there with the neighbor across the street from me who's dog & cat would leave his fenced in yard to go on my front lawn. My problem with the dog was solved when the dog died last year of old age. Not wishing your neighbor's dog ill....... Just letting you know that you are not alone in this struggle with stupid, irresponsible pet owners.

Best wishes and do keep us posted.

Try the video camera idea then ;)

it's easier than you think you dont have to prove beyond a reasonable doubt(criminal standard for a guilty charge)
pics of the dog on your lawn, yellow patches is enough.
a written log of when you observe the dog on lawn, record of the police being there( report or not) when you spoke to the dog owner etc.

Call the police next time you see the dog on your lawn, let them tell you it's civil word will get around that they were there he'll get the hint

preponderance of the evidence

yellow lawn

I had the same issue with my neighbor across the street from me. I confronted her & I was not rude but she did not care. Told her to let her dog pee on her property but she just would let her beagle (on a leash) do his thing on my lawn. The 2nd response from CIA worked for me, they will almost always go back to pee in one of the yellow spots on your lawn. generously sprinkle chili powder, cayene pepper & red pepper all along the spots on your lawn & watch the dog go crazy when he inhales the pepper. Better than that is watch the owner freak out because she does not know whats going on with her dog. I could not stop laughing oh I owned a golden retriever at the time & have dogs for most of my life so I love dogs but sometimes you have the teach the owner a lesson at the dogs expense. The Vet propbably squirted some water up the nose to clear the pepper. also cost her some $$$$.
now she goes on the other lawns with her dog & now my neighbors are pissed.
