I know coral are animals, but they sure look like flowers, and they do utilize light, try raising puppies in a greenhouse

I'd not waste money trying to sue ebay if I were you, you will lose imo

er-

a snail moves about, and isn't a plant....

yet you didnt know that it was an animal, until you looked up the definition of animal (which you actually had to do)

ergo-you did not know the difference between a plant and an animal

do i still need to clarify? or do you want to embarass yourself further ?

i'd suggest you give it a rest for a short while, think about it over the weekend, and respond if and only if you have to. i mean, feel compelled in some profound way

Psssst, Eddie...

May want to take your own advice and re-read. I said "The sale of live animals is prohibited on eBay."

I didn't make the leap that they consider live corals and sea stars and other invertebrates to be "plants".

If you want to read between the lines in context, what I was implying was NOT that eBay considers these organisms to be plants, but rather they do not choose to enforce their own rules where these organisms are concerned.

I did a quick search on the "Help" section of ebay.com using "sale of live animals" as my search terms. Here is what I found:

Animals and Wildlife Products

eBay generally does not allow the listing of live animals or pets on eBay. In restricted cases, some stuffed birds and the pelts and skins of some animals are permitted. Sellers who wish to list these items should review the specific rules in the “Some Examples” section below to ensure their listings comply with eBay policy. We also encourage members to educate themselves on the laws governing the regulation of the sale of animals found in the additional information section.

Violations of this policy may result in a range of actions, including:

Listing cancellation
Limits on account privileges
Account suspension
Forfeit of eBay fees on cancelled listings
Loss of PowerSeller status

Under "Examples" I found:

Live Animals: Other than the exceptions noted here, eBay does not allow sales of live animals or pets on eBay. eBay allows sales of tropical fish and domestic (i.e. not exotic) aquatic snails, provided the seller has the proper Federal (APHIS PPQ) - see Form 526 info below) and/or State permit(s) that allows for movement across State lines (and/or for importation into the U. S.), and provided that the seller guarantees in the listing that the animals will be packaged safely, and shipped via next day delivery.

Animal and Plant Health Inspection Service allows five species of snails to be imported and sold as escargot: Cantareus apertus (Helix aperta), Cryptomphalus aspersus (Helix aspersa), Eobania vermiculata (Otala vermiculata), Helix pomatia, and Otala lactea; and requires their importation to take place through John F. Kennedy International Airport in New York where identifiers will confirm the identity of live snails.

So... *technically*, eBay does not permit the sale of live coral, sea stars, or imported snails such as Mexican Turbos, Tonga Nassarius, Trochus grazers or any of the myriad of others offered. Kiki's "Kit" of nudibranchs would be against their policy too. Marine fishes are not mentioned, only tropical fish (which to me implies freshwater fishes)...

I know that many have complained to eBay about this and complaints have fallen on deaf ears, but if you want to follow the letter of eBays policies, there they are.

I will post a link since I am to dumb to cut and paste

I think in another post you implyed they were considering them plants

I am sorry if you did not make the bold leap kalk made(imo) I thought you did but dont care to reread all that you've said to confirm, in other threads

I stand corrected,I should have known "you" would not make that mistake

Nope, I don't care to talk about terrestrial plants. I am what you call a "brown thumb". I look at a terrestrial plant and it dies.

If you care to read back I'm sure you will find that I never implied directly or indirectly that eBay considers these organisms to be plants. If Jeff did, I can't speak for him but I'm sure he made the comment facaetiously. He also works in the horticultural field so I'm quite certain he knows the difference.

Try again, Eddie, I had already found that for you.
